Defendants represent a group of public and private entities that together own FCPP. The two unit, 1,540-megawatt Four Corners (Navajo) Power Plant, located on the Navajo Indian Reservation west of Farmington, New Mexico, is operated by APS. APS is Arizona largest and longest-serving electric company, providing more than 1.1 million retail and residential customers in 11 of 15 Arizona counties.
The EPA began an investigation of the FCPP in 2009, as part of the EPA Power Plant Initiative. Four NGO also began investigating the FCPP and filed a complaint with violations of the New Source Review and Prevention of Significant Detorioration program in 2011 specifically alleging that APS made modifications to FCPP Units 4 and 5 in 1985, 2007 and 2008 that triggered PSD review. These NGO collectively were Dine CARE, the National Parks Conservation Association, To Nizhoni Ani, and Sierra Club, of course.
